        <![CDATA[<p>A recent study showed that not only in New York, but all over the nation, fatal accidents caused by cellphones are being underreported. Specifically in New York, there was only one reported fatal crash attributed to a cell phone in 2011, while in 2010 there only ten. As a comparison, Tennessee, the state that reported the most fatal car accidents that were related to cell phone use, reported 93 crashes in 2011 and 71 in 2010.</p>

<p>Some <a href="http://www.jaroslawiczandjaros.com/Personal-Injury/Wrongful-Death/" target="_blank">New York City wrongful death lawyers</a> and other experts may point out that because New York is so much larger than Tennessee, this discrepancy calls into question the reliability of the underlying statistics; these experts instead believe that accidents related to cell phones are being widely underreported.</p>]]>
        <![CDATA[<p>There are certainly various reasons for this underreporting, but one belief is that unless a witness at the accident such as a driver, passenger or bystander mentions that a cell phone was in use, it can be difficult, if not impossible to prove it. Because of that difficulty, it is believed that crashes related to cell phone use are likely much higher than currently reported simply because drivers do not want to get in trouble for causing an accident while talking on the phone.</p>

<p>When someone is involved in an accident, the most important thing is to get them medical attention immediately. After that is taken care of, however, getting an accurate report in writing, even if doing so entails taking down the information by hand, can be critical. In particular, filling out a detailed report immediately may help a person establish whether or not a driver was on his or her cell phone at the time of the wreck. <p>The perpetrator in this case was caught trying to cross the New York border into Canada to evade authorities. The accident he was allegedly involved in took place on February 18 when he is said to have struck a 38-year-old pedestrian while driving a van for his job. He did not stop and instead left the scene of the crime. Investigators learned that he was the one driving the van at the time, but then gave a false statement to try and evade authorities. Federal agents tracked the driver down and arrested him. At his hearing, his attorney claimed that he was going to Canada to visit a friend and was unaware that he was wanted for the fatal car accident.</p>]]>
        <![CDATA[<p>Whenever a family member is killed in an accident it is always a tragedy. When the driver who killed him tried to flee the scene, it makes it even worse because it's that much harder to bring him to justice for taking a life. However, once that person is caught and brought to justice, the family can begin to get closure for the horrible event. However, there are still likely to be outstanding medical bills, funeral expenses and lost wages to go along with the loss of life. <p>Construction workers were inside the structure when a collapse occurred and they suffered a fall from a height of at least 10 feet. It is believed that it was a support structure that gave way that resulted in the fall. One worker had to be flown to Westchester Medical Center because it is believed he may have suffered possible bone fractures. The other workers were also taken to the hospital, though it is unclear the extent of their injuries at this time. <p>The accident took place near New York City back in January and involved a total of eight vehicles, including the vehicle where an 82 year old victim was killed and a 79 year old passenger in the same car was severely injured. The man responsible for the fatal car accident is due in court again very soon and was charged with driving under the influence of drugs as well as leaving the scene of an accident. While he was driving, he hit five vehicles and then hit two other moving cars while trying to pass between them, including one going the opposite direction, which was the one that had the two aforementioned victims. Another victim was also treated for minor injuries from the accident.</p>]]>
        <![CDATA[<p>Any time a loved one is lost, no matter what the circumstances, it is always a tragedy. That way, the civil issues can go as quickly as possible. Most of the time, a civil suit must be brought in order to recover for any medical bills and funeral expenses, as well as sometimes for lost wages if the family member killed was a primary earner. <p>The accident occurred in New York City, when the alleged perpetrator was driving over 70 miles per hour. Reportedly, he struck a car carrying a husband and pregnant wife.         <![CDATA[<p>Most banks provide ATMs which are available in a lighted area in front of the bank and which are accessible twenty-four hours a day seven days per week to persons with a bank card and code.</p>

<p>Criminals have figured out that most people who use an ATM have an ATM card and money in the bank. It has therefore become a frequent occurrence that the criminal element targets ATM users in bank vestibules.</p>

<p>When a bank provides an ATM, it must also provide a working locking mechanism in the vestibule door which can only be accessed by persons with valid ATM cards. When the vestibule lock is broken it creates a potential for a crime. When the bank has notice of it either because it knows of the condition or because the lock has been broken for a long enough time that the bank knew or should have known about it the bank may be held responsible.</p>

<p>It is obviously foreseeable that in a situation where a vestibule door lock to an ATM area is broken a criminal attack upon a user of the bank's ATM on the bank's premises may occur.</p>

<p>Where a criminal act is foreseeable, the bank cannot use the excuse that there was a criminal attack in an attempt to avoid its responsibility. Obviously banks must take reasonable precautions to <a href="http://www.jaroslawiczandjaros.com/Personal-Injury/Premises-Liability/">secure the premises</a>. The restaurant is located on Tenth Avenue in Manhattan near Madison Square Garden where "Clyde" Frazier is a sports announcer for the Knicks.</p>

<p>The person was injured while trying to carry materials down a ramp leading to an exit of the restaurant. It was dark and the ramp was in a state of disrepair and he was caused to fall and be seriously injured.</p>

<p>A new study performed in New York City at Columbia University reviewed the medical records for over 264,000 women who had their uterus removed for noncancerous conditions from 2007-2010. Laparoscopic procedures, minimally invasive procedures where the robot is an option, had a complication rate that matched the procedure done without a robot, at 5 percent.</p>]]>
        <![CDATA[<p>Those hoping for an error-free robotic surgery, in other words, should think again. The surgical robot is still controlled by a human surgeon, with all of the risk of error and negligence that accompany any traditional procedure. And any type of hospital errors or surgical negligence, whether brought on by a human or a robot, may be difficult to spot. For many, symptoms may take months or even years to show up, and may go unnoticed until a checkup or x-ray is performed.</p>
<p>If during follow-up examinations after a surgery, it becomes apparent there may have been a surgical error, then seeking out help immediately is essential.
