A U.S. federal judge ruled against the insurance company and found that the policy applied for a well-known restaurant in New York City that was represented by Jaroslawicz & Jaros. In a leading case in the area of insurance law that was reported in The New York Times and the New York Law Journal, a U.S. federal judge ruled against the insurance company and found that the company had to defend and that the insurance policy applied. In Barney Greengrass, Inc. v. Lumbermen’s Mut. Cas. Co., 09 CV 7697 (NRB), United States District Court for the Southern District of New York. The court found for the restaurant that the insurance policy did apply and that odors that were claimed may have come from the restaurant were not subject to the pollution exclusion in the restaurant’s policy. In a leading case interpreting the lien law of New York state, the firm of Jaroslawicz & Jaros was successful in bringing a case on behalf of a building owner against the city of New York in a case where David Jaroslawicz of Jaroslawicz & Jaros wrote the brief and argued before the New York Court of Appeals, the highest court in the state of New York. LMWT Realty Corp. v. Davis Agency, No. 90, COURT OF APPEALS OF NEW YORK, 85 N.Y.2d 462; 649 N.E.2d 1183; 626 N.Y.S.2d 39. The New York Court of Appeals held that an attorney’s charging lien had priority when the attorney’s efforts had produced a fund subject to a taxing entity’s special lien imposed on fire insurance proceeds.
