Adult survivors act

In November of 2022 the Governor of New York signed the Adult Survivors Act. This law permits New York survivors who were sexually abused as adults to take legal action until November 24, 2023. This means that even though the abuse may have happened many years ago you can now sue your abuser and the Statute of Limitations no longer applies.

This Act is very important as it is common knowledge that victims of abuse often take many years to recover and have the strength and will power to bring a lawsuit against their abuser. Unfortunately, because of the Statute of Limitations many victims were unable to pursue their abuser in the time permitted by law. This Statute of Limitations has now been lifted for a one (1) year period until November 24, 2023.

Almost forty years ago, when other attorneys were reluctant to take on these types of cases, and when these types of lawsuits were relatively unknown, Jaroslawicz & Jaros was successfully representing victims of sex abuse and rape.

We filed one of the first lawsuits alleging the sexual abuse of two (2) teenage boys, by a Franciscan Brother, who at the time was also their Boy Scout leader. As the abuse occurred in both New Jersey and New York we sued both the Church and the Boy Scouts in New York and in New Jersey. This case was appealed all the way up to New Jersey’s highest court, as well as New York’s highest court, The Court of Appeals.

David Jaroslawicz, of Jaroslawicz and Jaros, successfully wrote and argued the Appeal of a woman who sued the Commodities Exchange, Inc., known as COMEX, alleging that she was sexually harassed while working at the COMEX as a commodities trader. This case was decided by the Appellate Division First Department, finding, for the first time, that an organization, the COMEX, may be held liable under New York’s laws for aiding and abetting discriminatory conduct. The appeal was written and argued by. see D’Amico v. Commodities Exchange, Inc., 652 N.Y.S.2d 294.

Over the many years that we at Jaroslawicz & Jaros have been representing victims of sexual abuse and assault the attitude of the Courts and the authorities towards these cases has, fortunately, slowly changed for the better, with more sympathy and consideration for the victims.

The Courts and juries have also come to recognize the seriousness of these types of allegations and the long-term life altering effects and consequences that this type of conduct can have on the unfortunate victim.
