What I Need to Know If I Was Injured While Visiting New York

If you were injured while visiting New York and want to file a lawsuit to seek compensation for your injuries you need to hire an attorney to represent you. New York personal injury attorneys will represent you on a contingency fee basis, which means you will not pay any attorney fees unless your case is successful.

Your attorney will also agree to advance the expenses to prosecute your case and will only recover those expenses if your case is successful.

If you do decide to file a lawsuit, your attorney can handle everything without your presence being necessary but your presence will be required on two occasions during the proceedings.

The two instances when you will need to appear are:

1) To testify at your deposition, where the other side will have the opportunity to question you about the accident and the extent your injuries;

With the prevalence of remote conferences since Covid, and the almost universal use of Zoom, most plaintiffs are now able to testify by using Zoom and no longer have to come to New York to provide testimony at their deposition.

The second is:

2) For a physical examination by a doctor the other side will hire to examine you. That doctor will write a report describing your injuries, and if the case proceeds to trial, this doctor will then testify against you to try to minimize the extent of your injuries and limit your recovery.

This examination generally occurs after your deposition testimony and most often results in this doctor finding that either, you were never injured, if you were injured you are fully healed and need no further medical treatment, or, that your injuries were not caused by this accident.

As your attorneys we will gather all of your medical records and radiology reports and have you see a doctor on your behalf while you are in New York so that you do not have to make a special trip to New York. This doctor will support your case and explain the extent of the injuries you suffered and what medical care you will need in the future.

As we are aware that not everyone can easily return to New York City, even if it is only for one or two appearances, we can help make your travel arrangements and also cover your costs.

If you or a loved one were injured and are in need of legal assistance as a result of an injury suffered from an accident while visiting New York, then call the Lawyers at Jaroslawicz & Jaros at 212-227-2780, or submit an online questionnaire

The initial consultation is free of charge, and if we agree to handle your case, we will work on a contingency fee basis, which means we get paid for our services only if there is a monetary recovery of funds.
